The proclamation of the Freedom of Information Act 1992 (WA) ("the FOI Act") in November 1993 created a legal right of access to documents held by all state and local government agencies (section 10). The Department of the Premier and Cabinet's FOI Unit coordinates the receipt and processing of all FOI applications relating to the Department as well as providing a bureau service to the newly formed Public Sector Commission (PSC). As such, although the PSC is a separate agency under the FOI Act , FOI applications with regard to the PSC should be forwarded to DPC for processing.

State Government Ministerial Offices are separate agencies under the FOI Act and FOI applications relating to those agencies should be forwarded directly to the relevant ministerial office.
